For many organisations, the combination of a downturn in trading, and resultant cash flow pressures, may be enough to cause financial stress or even a crisis. To give your organisation the best chance of recovery, you need to react quickly and effectively to signs of decline. If specialist corporate restructuring advice is sought and issues are dealt with promptly at the early stages of the decline curve, it's possible to maximise your recovery opportunities. By contrast, neglecting or misdiagnosing the situation could eventually lead to insolvency and failure.
Work in partnership with RSM’s corporate restructuring experts to diagnose and deal decisively with the issues you face.
At RSM, we provide advice to boards and other stakeholders (lenders, investor groups, various classes of creditors, public bodies etc.) on crisis stabilisation, turnaround strategies and corporate restructuring plans.
We will make sure all available options for renewing a business and revitalising prospect are considered, including implementation of the restructuring plan, accelerated mergers or acquisitions, providing forecast assurance to external stakeholders or, where appropriate, in relation to formal insolvency procedures such as pre-pack receiverships and examinership.
Examinership or examination is a process of attempting to formulate a survival plan for a viable insolvent company which is administered through a court process. There are strict reporting timeframes for formulating a Scheme of Arrangement to be approved by creditors and the court. We have been involved in many successful examinerships resulting in the survival of the company and the preservation of jobs. The recent changes in examinership legislation now allows smaller companies to apply for protection through the circuit court. This amendment makes examinership a viable insolvency procedure for a wider range of companies including SMEs facing financial difficulties.
In certain circumstances a Scheme of Arrangement under the improved procedure bought in by the Companies Act 2014 may be appropriate. Our professionals will advise whether this is a viable option which will depend on the specific facts of the case.
Through our international network we are also able to draw upon local knowledge for cross border assignments. Our list of successes includes rescue and restructuring projects around the globe.
