Secondment of an employee abroad to Hong Kong for taking up short or long-term assignments or on a permanent basis is not a simple and straightforward exercise. Unless the overseas employee has a Right of Abode, a Right to Land or an Unconditional Stay in Hong Kong, otherwise, a valid Hong Kong Employment Visa is required for the overseas employee to apply with the Immigration Department before taking up any sort of employment whether it is paid or unpaid, short-term or long-term in Hong Kong.
In general, to get the Hong Kong employment visa successfully granted by the Immigration Department to the applicant (e.g. the expatriate employee), both the Company (acting as a sponsor) and the applicant are required to satisfy the requirements of the Immigration Department:
- The sponsoring company must be financially viable and have established an office premises and hired local employees.
- The applicant must possess unique qualifications, relevant working experience and expertise that are scarcity in Hong Kong labour market.
- Valid proof of the above-mentioned items for substantiation of the application as required by the Immigration Department.
