All business entities are exempt from liability until January 01, 2024

The Government of the Republic of Serbia amended the Regulation on unique technical and technological requirements and procedures for the preservation and protection of archival material and documentary material in electronic form, thus postponing implementation, which was to begin on September 01, 2022. Implementation of regulations on the preservation of archival material in electronic form has been postponed until January 01, 2024.

The Decree sets out the obligations of the creator and holder of the documentary material in electronic form in terms of reliable storage and archiving, sets out the way of supervising by the competent archive, and the procedure of extracting and destroying documentary material in electronic form and extraction and handing over the archive of documentary material that is kept permanently within 30 years of the creation of this material.

The Decree elaborates obligations under the Law on Archival Construction and Archival Activity, where the obligation to keep the archive book in electronic form is prescribed, but - now with the postponed application to enter into legal force from the beginning of January 2024.
