Equal Pay Certification: Our experts answer you!
As a result of the recent enactment of the new Equality Act amendment, companies are now subject to equal pay analysis. As of July 1, 2020, companies with 100 or more employees will be required to analyze and verify the equal distribution of wages among their employees. In other contexts, this analysis may even be necessary for companies that are not affected by these size criteria. For example, if you wish to participate in a tender in the canton of Basel-Stadt, you will be required to submit an equal pay certification, regardless of your company's size.
This analysis must be carried out every 4 years. It is important to note that if the first analysis is correct and the principle of equality is respected, no further analysis will be required from companies. This control must be shared with the employees in writing and published in the appendix of the company's annual accounts if it is listed on the stock exchange.
Companies are required to have this analysis reviewed by an independent body such as a company licensed under the Audit Supervision Act. Registered auditors may perform this review, but it is performed as a separate mandate, outside the audit mandate. The auditor in charge of the mandate will then have to have undergone specialized training in this field to be able to conduct this analysis.
